STATEMENT OF FACTS:
1. Ron Sims, former King County executive, Christy A. Todd, former interim city manager of the city of Maple Valley, and Brian Ross, president of Summit Place 156 LLC, all signed the Memorandum of Agreement Regarding Joint Planning, Interim Zoning, Pre-Annexation Zoning and Future Annexation of the Summit Pit Property ("the MOA") on October 2, 2008.
2. On October 13, 2008, the Maple Valley city council ratified the MOA. On December 15, 2008, the King County council passed Motion 12899, ratifying the MOA.
3. In accordance with Section 5 of the MOA, representatives from the county and the city met to negotiate the terms of a joint planning interlocal agreement to set forth the general goals, principles and policies to be considered when adopting future land use designations and zoning for the Summit Pit Property. Representatives of Summit Place 156 LLC attended those discussions. The city and county reached an agreement to the terms of the joint plan for the Summit Pit property, now referenced as the Summit Place property. Summit Place 156 LLC approves of the terms of the Summit Place Joint Plan.
4. In accordance with the MOA, the goal was to have both the legislative bodies of both the city and county approve the joint planning interlocal agreement by June 30, 2009. However, as a result of prolonged negotiations, the parties were only able to reach agreement to the terms of the joint planning interlocal agreement in April 2010.
5. The Summit Place Joint Plan is Attachment 1 to the interlocal agreement and by reference integrated into the joint plan interlocal agreement. On May 3, 2010, the Maple Valley city council conditionally approved of the interlocal agreement attached to this ordinance as Attachment A.
