AN ORDINANCE authorizing the executive to enter into an interlocal agreement with the Valley Communications Center for the establishment of joint projects regarding the replacement, upgrade, maintenance, and repair of equipment in that portion of the Valley Communications Center that is part of the regional emergency communication system and is owned by both King County and Valley Communications Center, as well as Valley Communications Center separately owned and operated equipment not within the regional emergency communication system.

STATEMENTOF FACT:
1. Ordinance 10464 and K.C.C. chapter 2.58 established an emergency regional radio communications system ("the system"). That system has been constructed and is in use by the entities described in K.C.C. chapter 2.58, including the county and Valley Communications Center ("Valley Com").
2. Portions of the system's microwave infrastructure, known as the "Southloop Microwave," need to be replaced because of increasingly high operating costs, equipment obsolescence, limited availability of spare parts and capacity constraints.
3. The county and Valley Com jointly were awarded a grant from the United States Department of Commerce through the state of Washington to pay for most of the Southloop Microwave replacement. The grant requires a twenty percent match from recipients that can be met by either direct cash expenditures or in-kind contributions to the project.
4. The county and Valley Com desire to enter into an interlocal agreement, in substantially the same form as attached to this ordinance, to upgrade, replace, maintain and repair those portions of the system that are jointly owned by Valley Com and the county or are owned solely by Valley Com, subject to the availability of funding to pay for the work to be performed.
