AN ORDINANCE approving an application for renewal of a franchise with Sprint Communications Company L.P., for use of certain road rights-of-way in unincorporated King County for the construction, operation, and maintenance of wireline telecommunications transmission facilities.

STATEMENT OF FACTS:

1.  In 2015, Sprint Communications Company L.P. (previously operating as U.S. Sprint Communications Company Limited Partnership), filed an application to renew its nonexclusive franchise for the construction, operation, and maintenance of wireline telecommunications transmission facilities within certain rights-of-way in unincorporated King County. 

2.  The application was referred to the facilities management division of the department of executive services for development of the terms and conditions for a right-of-way franchise with Sprint Communications Company L.P., in accordance with K.C.C. 6.27.050.A.1.  At the request of the facilities management division, the application was updated in 2017.

3.  The application has been reviewed by the roads services division of the department of local services roads division, in accordance with K.C.C. 6.27.050.A.2.

4.  The King County executive recommends approval of the franchise and hereby refers such to the King County council for hearing and decision, in accordance with K.C.C. 6.27.050.A.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  The metropolitan King County council, having determined that the application by Sprint Communications Company L.P, meets the criteria for granting of a right-of-way franchise and that the grant is in the best interests of the public, does hereby

approve the terms included in the attached franchise agreement and authorizes the King County executive to execute an agreement with substantially the same terms.
