STATEMENT OF FACTS:
1. The Lake Washington school district filed a petition requesting vacation of a portion of 99th Place NE, hereinafter described.
2. The department of local services notified utility companies serving the area and King County departments of the proposed vacation. Puget Sound Energy required an easement over the vacation area, and the King County department of natural resources and parks, water and land resources division, required an access easement. Petitioner has provided those easements.
3. The department of local services records indicates that this segment of right of way is opened and maintained. Petitioner has entered into a covenant with the county to assume all responsibility for the drainage infrastructure currently within NE 99th Place.
4. The department of local services considers the subject portion of right of way useless as part of the county road system and believes the public would benefit by the vacation of this segment of right of way.
5. Due notice was given in the manner provided by law. The office of the hearing examiner held the public hearing on April 30, 2020.
6. The examiner found that the subject right-of-way is useless as part of the county road system, concluded that the public will benefit from its vacation, and recommended a full waiver of compensation.
7. For the reasons stated in the examiner's June 10, 2020, report and recommendation, the council determines that it is in the best interest of the citizens of King County to grant said petition and vacate the right-of-way, without requiring compensation.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. The council, on the effective date of this ordinance, hereby vacates and abandons a portion NE 99th Place right of way as described below:
