AN ORDINANCE revising the corporate boundary of the city of Normandy Park to fully include Southwest 168th Street and Southwest 170th Street right-of-way within the city as provided for in RCW 35A.21.210.

STATEMENT OF FACTS:
1. RCW 35A.21.210 provides the mechanism to allow cities within King County to adjust their boundaries to include entire rights-of-way of roads within the city. RCW 35A.21.210 provides that "[t]he governing bodies of a county and any code city located therein may by agreement revise any part of the corporate boundary of the city which coincides with the centerline, edge, or any portion of a public street, road or highway right-of-way by substituting therefor a right-of-way line of the same public street, road or highway so as fully to include or fully to exclude that segment of the public street, road or highway from the corporate limits of the city."
2. Revision of the corporate boundary of a city is effective upon approval by the city council and the county legislative authority as provided for in RCW 35A.21.210.
3. King County has jurisdiction over the northern half of the road right-of-way for Southwest 168th Street in the area described in Attachment A to this ordinance. King County also has jurisdiction over the northern half of Southwest 170th Street in the area described in Attachment B to this ordinance.
4. It is in the city and the county's best interest to amend the corporate boundary of the city so that the county road right-of-way described in Attachments A and B to this ordinance is located in its entirety within the city so that the city may provide local services to its residents including the maintenance and operation of the public right-of-way.
