AN ORDINANCE authorizing the condemnation of property interests needed for the Fifteen Mile Creek Bridge No.493C replacement project located in unincorporated King County along SE May Valley Road 0.2 miles west of Issaquah-Hobart Road SE in council district nine.

SECTION 1. Findings:
A. King County's Fifteen Mile Creek Bridge No.493C project will replace the existing King County timber bridge originally built in 1932 that is now past its useful life. The existing timber bridge is located on Southeast May Valley Road that connects the cities of Issaquah, Renton, and Maple Valley and unincorporated King County. The property rights that are the subject of this ordinance must be acquired for the Fifteen Mile Creek Bridge No.493C project. The county and the property owner were unable to agree on a voluntary transfer of the property rights.
B. The new bridge will be designed and constructed to meet current national bridge standards that include weight capacity, lane and shoulder widths, and environmental protection. Those standards improve safety by adding standard eight-foot shoulders for people walking, biking, and rolling and benefit the environment by replacing the existing wooden bridge support piles that are treated with creosote, which can be harmful to fish and the environment and replaces them with an out-of-water steel and concrete support system.
C. King County is authorized, by chapter 8.12 RCW, chapter 36.56 RCW, chapter 35.58.200 RCW, and chapter 35.58.320 RCW, to acquire, damage, and condemn certain properties, property rights, and rights in property for the public use for road facilities.
D. To carry out the Fifteen Mile Creek Bridge No.493C project, it is necessary for King County to condemn and damage certain lands, property rights, and rights in property.
