Title
AN ORDINANCE authorizing the King County executive to enter into and implement an interlocal agreement, under chapter 39.34 RCW, with the cities of Auburn, Bellevue, Federal Way, Issaquah, Kent, Kirkland, Mercer Island, Redmond, Renton, Seattle and Tukwila, relating to the Puget Sound emergency radio network project; and amending Ordinance 17929, Section 20, and K.C.C. 4A.xx.xxx.

STATEMENT OF FACTS:
1. King County currently has a countywide emergency public safety radio network that supports over sixteen thousand radios and over one hundred separate police, fire, emergency medical and other governmental agencies.
2. The network was funded by a countywide ballot measure placed on the ballot by the council's adoption of Ordinance 10464, and approved by the voters of King County in September 1992.
3. Portions of the network are separately owned by the Eastside Public Safety Communications Agency, the Valley Communications Center, Seattle, and King County (collectively "the co-owners") with a jointly owned switch controlling the entire network.
4. The network is approaching twenty years old, and is increasingly requiring repairs.
5. The network's vendor has stated that it will stop supplying replacement parts and repairing used parts for the network by December 31, 2018. King County must replace the network or risk performance degradation.
6. The council previously established a capital improvement project to plan for the network's replacement.
7. Executive staff has been working with the network's users and co-owners to plan the network's replacement with a new network to be known as the Puget Sound emergency radio network.
8. Voters approved on April 28, 2015, a funding measure to deploy a new Puget Sound emergency radio network infrastructure and replace the current network's subscriber units and dispatch consoles currently in use.
9. Representatives for the cities of Auburn, Bellevue, Federal Way, Issaquah, Kent, Kirkland, Mercer Island, Redmond, Renton, Seattle and Tukwila and King County have negotiated with the King County executive a proposed interlocal agreement ("ILA 1"), which is Attachment A to this ordinance, that designates King County as the lead agency for planning, procurement, financing, implementation, and limited operation of the Puget Sound emergency radio network system. These responsibilities will include negotiating and executing approximately forty-three real property leases to be used for siting Puget Sound emergency radio network antennas, transmitters and other equipment.
10. ILA 1 also establishes a joint board to oversee the Puget Sound emergency radio network project if funding is secured. The joint board would have four voting members: one member jointly selected by the cities of Auburn, Federal Way, Kent, Renton and Tukwila; one member jointly selected by the cities of Bellevue, Issaquah, Kirkland, Mercer Island and Redmond; one member selected by the city of Seattle; and one member selected by King County. All votes would be equally weighted.
11. The joint board would also have two nonvoting members: one member selected by the King County Police Chiefs Association; and one member selected jointly by the King County Fire Commissioners Association and the King County Fire Chiefs Association.
12. Under ILA 1, during the implementation period for the Puget Sound emergency radio network project, King County would enter into contracts with vendors and have lead responsibility for managing those contracts on a day-to-day basis. The joint board would have the responsibility for approving high-level policy and technical decisions such as the final design of the Puget Sound emergency radio network, the project schedule, and acceptance of major deliverables.
13. In addition, ILA 1 commits its signatories to form a nonprofit corporation to own, operate and govern the Puget Sound emergency radio network after it is built and fully tested. Upon system acceptance, ILA 1 requires properties leased by the county for siting Puget Sound emergency radio network antennas, transmitters and other equipment be assigned to the nonprofit corporation.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. The King County executive is hereby authorized to enter into an interlocal agreement, in substantially the same form as Attachment A to this ordinance, with the cities of Auburn, Bellevue, Federal Way, Issaquah, Kent, Kirkland, Mercer Island, Redmond, Renton, Seattle and Tukwila for the Puget Sound emergency radio network project, and to take all actions necessary to implement the terms of the interlocal agreement.
SECTION 2. As part of the interlocal agreement implementation, under section 4 of the agreement, the parties to the interlocal agreement agree to create a joint board. Before the executive may identify any person to the joint board's chair as either the county's primary or alternative representative in accordance with section 4.2.4 of the interlocal agreement, the executive shall transmit to the council a motion for each representative confirming their selection, together with such supporting and background information regarding the proposed representative as the executive deems would assist the council in considering confirmation. The motion shall specify for which
representative position the person is being proposed. Confirmation or rejection shall be by council motion.
