AN ORDINANCE authorizing the King County executive to enter into a renewal for leased space at the Graybar building located at 416 Occidental Avenue, Seattle, Washington.

      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  Findings:
      A.  The lease for 416 Occidental Avenue covers 33,000 square feet of space occupied by a variety of King County users including but not limited to the department of transportation, the facilities management division building services section, the print shop, and the records and licensing division, records management section.  The county has leased this space since July 1999, and the current lease expired on June 30, 2009.
      B.  In accordance with K.C.C. 4.04.040 the King County council may adopt an ordinance permitting the county to enter into contracts requiring the payment of funds from the appropriation of subsequent fiscal years.  Additionally, Ordinance 15328 was passed by the King County council on November 21, 2005, amending the provisions of K.C.C. 4.04.040 and limiting lease terms, where the county is the lessee, to a cumulative total of two years.  The lease mentioned in this section is subject to Ordinance 15328 and K.C.C. 4.04.040.
      SECTION 2.  The King County executive is hereby authorized to take all actions necessary to implement this lease and all actions up to now taken by county officials, agents and employees consistent with the purpose and express terms of the lease agreement are hereby ratified, confirmed and approved.
      SECTION 3.  If any one or more of the covenants or agreements provided in this ordinance to be performed on the part of the county is declared by any court of competent jurisdiction to be contrary to law, then such covenant or covenants, agreement or agreements are null and void and shall be deemed separable from the remaining covenants and agreements of this ordinance and in no way affect the validity of the other provisions of this ordinance or of the lease.
      SECTION 4.  The King County executive is hereby authorized to execute the
 
lease in substantial form as attached hereto for a term of ten years at 416 Occidental Avenue, Seattle.
