STATEMENT OF FACTS:
1. The Washington state Department of Transportation ("WSDOT"), in the interest of improving safety, reliability and mobility, proposes to design and construct improvements along State Route ("SR") 520 from Interstate 5 to SR 202 as part of the SR 520 Bridge Replacement and HOV program ("the program"), and the county and WSDOT recognize the program will affect existing transit facilities.
2. One of the four independent projects, entitled SR 520, Medina to SR 202, Transit and HOV project ("the project"), involves reconstruction of the existing transit facilities located within WSDOT's limited access at Evergreen Point Road and at 92nd Avenue Northeast.
4. WSDOT and the county recognize that meaningful consideration of public transportation needs and perspective in the planning, design, community outreach, operations and maintenance and construction of the transit facilities are essential to the success of the project. However, the determination of the final design of the project is within WSDOT’s sole discretion and should be consistent with the commitments WSDOT has made to the cities of Clyde Hill and Medina and the towns of Hunts Point and Yarrow Point.
4. WSDOT agrees that reimbursing the county for staff time spent reviewing and providing input in the planning, design, and construction of the transit facilities will expedite design of the project, thereby minimizing delay and costs to the project.
