A RESOLUTION of the Board of Supervisors of the King County Flood Control Zone District approving a template for grant agreements related to the administration of the King County Flood Control Zone District’s grant programs.

WHEREAS, the King County Flood Control Zone District provides grant funding for projects with flood reduction benefits, and watershed restoration and protection, and
WHEREAS, pursuant to the Interlocal Agreement between the District and King County, King County oversees the District's grant programs including the solicitation of applicants and the execution of an agreement governing the terms and conditions by grant recipients, and
WHEREAS, in order to ensure uniformity in the administration of the District's grant programs, the Board of Supervisors through FCD Resolution FCD2022-13, in Section 5, directed the executive director, District legal counsel, and King County to work collaboratively to develop template grant contracts for the District's grant programs and submit the template to the District for approval by March 31, 2023, and
WHEREAS, in early 2023, the executive director, legal counsel and King County have worked together to develop a template contract;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE KING COUNTY FLOOD CONTROL ZONE DISTRICT:
SECTION 1. The Board of Supervisors of the King County Flood Control Zone District adopts the template grant agreements attached hereto as Attachment A to this resolution, Cooperative Watershed Management Grant Funds, for use by King County for the grant programs funded by the District and administrated by King County.
SECTION 2. The Board of Supervisors of the King County Flood Control Zone District adopts the template grant agreement attached hereto as Attachment B to this resolution, Flood Reduction Grant Funds, for use by King County for the grant programs funded by the District and administrated by King County.
SECTION 3. King County is authorized to negotiate modifications to these templates with state and federal agencies as necessary, provided that any modifications are reviewed and approved by an attorney from the King County Prosecuting Attorney’s Office ("PAO") and approval as to form is noted on the modified agreement. King County is further authorized to execute amendments to the grant agreements as
necessary, provided that the amendments use a form approved by an attorney from King County PAO or are reviewed and approved by an attorney from the King County PAO.
