A RESOLUTION of the Board of Supervisors of the King County Flood Control Zone District authorizing King County to execute a quit claim deed related to property transfer associated with the Lower Russell Road Levee Setback Project.

                     WHEREAS, in 2019, the Board of Supervisors of the King County Flood Control Zone District executed an Interlocal Agreement with the City of Kent for the Lower Russell Road Levee Setback Project ("Project") to provide improved flood protection and scour protection as a key portion of the Green River levee system, and

                     WHEREAS, as a component of the Project and consistent with the Interlocal Agreement, King County purchased real property necessary to construct the Project with the intent of transferring ownership of the real property to the City of Kent at the conclusion of the construction of the Project, and

                     WHEREAS, pursuant to K.C.C. 4.56.060(E)(1), the District may, by resolution, direct the county to convey real property acquired by King County for a District project, and King County shall execute a conveyance document, in a form approved by the district, within sixty days, and

                     WHEREAS, construction on the Project has reached completion and the Board desires to transfer ownership of the real property to the City of Kent;

                     NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE KING COUNTY FLOOD CONTROL ZONE DISTRICT:

                     SECTION 1.  The Board of Supervisors of the King County Flood Control Zone District directs King County to execute a quit claim deed attached hereto as Attachment A to this resolution and incorporated herein by this reference, thereby conveying to the City of Kent the real property described therein.  The conveyance shall be executed and

transmitted to the City of Kent within sixty days from the effective date of this resolution.
