AN ORDINANCE permitting the county to enter into the agreement for public defense services between King County and the city of Seattle.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  Findings:

                     A.  On May 20, 2013, the King County council adopted Ordinance 17588 creating a department of public defense within the executive branch.

                     B.  K.C.C. 2.60.020 authorizes the department to provide public defense services to the state of Washington, tribal governments and municipalities in King County on a full cost recovery basis and to negotiate appropriate contractual agreements, subject to council approval by ordinance when required by law.

                     C.  King County and the city of Seattle value the expertise of public defenders providing services to the city of Seattle and recognize the need to maintain the continuity of services and to ensure that current and future clients have access to public defense services without disruption.

                     D.  Attachment A to this ordinance is the executed agreement for public defense services that secures the city of Seattle's ability to continue to receive public defender services and provides King County financial assurances for the years 2023 through 2027.  Attachment A to this ordinance was executed on behalf of the executive by the director of the department of public defense on September 29, 2022, and by the city of Seattle budget director on September 30, 2002.

                     E.  Subsequent to the execution of Attachment A to this ordinance, the executive transmitted this proposed ordinance for council's permission to enter into a contract that would commit the county to expend moneys beyond the biennium.

                     SECTION 2.  At the request of the executive, the council permits the county to

enter into the executed agreement for public defense services with the city of Seattle, which is Attachment A to this ordinance.
