AN ORDINANCE authorizing the execution of a franchise renewal agreement with the city of Seattle, for use of King County road rights of way in unincorporated King County for the construction and maintenance of electric transmission and distribution system facilities.

STATEMENT OF FACTS:

1.  The city of Seattle applied for and negotiated terms and conditions for use of King County road rights of way for the construction and maintenance of electric power facilities in council districts.

2.  The application and negotiated document was reviewed and approved by applicable county agencies before submission to the council.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  The city of Seattle's application and negotiated agreement meets the criteria for a right-of-way franchise for use of the right-of-way of county roads for the construction and maintenance of electric power facilities under K.C.C. chapter 6.27.

                     SECTION 2.  The executive is authorized to execute a right-of-way franchise agreement with the city of Seattle that is substantially in the form of Attachment A to this

ordinance, and to take all actions necessary to implement the terms of the franchise agreement.
