STATEMENT OF FACTS:
1. The city of Redmond has filed an application for a franchise in council district 3 to construct, operate and maintain a water system in the Rose Hill area of King County.
2. The Rose Hill water district served the city of Redmond's Rose Hill service area until 1994 when ownership and operation of the district water system was assumed by and divided among the cities of Bellevue, Kirkland and Redmond.
3. This franchise covers the unincorporated area of the Rose Hill service area that adjoins the city of Redmond's corporate boundaries.
4. The city of Redmond's comprehensive plan was approved by the King County council on July 8, 2003, under Ordinance 14696.
5. The King County utilities technical review committee reviewed the city of Redmond's proposed franchise and determined that it was consistent with the adopted water system plan, K.C.C. chapters 6.27 and 13.24.
6. The application has been referred to the relevant county departments for review.
7. The King County executive has recommended approval of the franchise.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. The granting of a franchise to the city of Redmond to construct, operate and maintain a water system within King County is hereby approved. The King County executive is authorized to enter into and execute the water system franchise, which by this reference is fully incorporated herein. Said franchise shall include all of the general and special conditions required by the county.
SECTION 2. If within forty-five days after the granting of this franchise, the applicant shall have failed to sign the written acceptance incorporated herein, then the
