AN ORDINANCE approving the 2007 Town of Skykomish 2007 General Sewer and Facilities Plan.

      STATEMENT OF FACTS:
1.  King County Code (“K.C.C.”) 13.24 requires approval of comprehensive plans for water and sewer utilities as a prerequisite to granting right-of-way franchises and approval for right-of-way construction permits.
2.  K.C.C. 13.24.060 requires that such plans be consistent with the requirements of any comprehensive plans or development regulations adopted under Chapter 36.70A RCW or any other applicable comprehensive plan, land use plan, or development regulation adopted by a city, town, or county for the service area.  The King County Comprehensive Plan, which includes water supply and wastewater policies in its provisions for facilities and services (policies F-225 through F-244), likewise calls for consistency with other adopted plans, support for regional water supply planning, pursuit of reclaimed water and water conservation, and protection of water resources.
3.  Both Washington State Department of Ecology (“DOE”) and King County regulations require sewer plans to be approved prior to commencement of construction.
4.  The Town of Skykomish (“the town”) is located in the Skykomish river valley in eastern King County approximately 50 miles east of Everett and 13 miles west of Stevens Pass.  The town has historically relied upon on-site septic systems for wastewater disposal.
5.  The town has been presented with a unique opportunity to replace failing and substandard septic systems with a centralized wastewater collection and treatment system in conjunction with an environmental cleanup program being conducted under the provisions of the Model Toxics Control Act.  The town's 2007 General Sewer and Facilities Plan (“the plan”) has been developed in conjunction with that effort.
6.  A force main will extend from the town's boundary to the wastewater treatment facility.  That portion of the pipeline that traverses unincorporated King County will be tightlined (preclude future connections) to comply with King County Comprehensive Plan Policy
F-249 and K.C.C. 13.23.132.
7.  DOE has approved the plan pursuant to WAC 173-240-050.
8.  The King County utilities technical review committee (“UTRC”) reviewed and approved the plan on June 18, 2008.  Chapter 13.24 of the K.C.C. requires review of wastewater plans by the UTRC, and a recommendation made to the King County executive and council on the plan and the requirements under K.C.C. 13.24 and consistency with the King County Comprehensive Plan.  The planning data and proposed operations were reviewed by the UTRC.  The plan is found to be consistent with:
 a.  the population and employment forecasts developed by the Puget Sound Regional Council for the service area were considered and, with a customized forecast, was appropriately used;
 b.  King County land use classifications;
 c.  Washington administrative code 173-240-050; and
  d.  pertinent county adopted plans and policies.  The UTRC recommends that the King County council approve the plan.
9.  The town completed a State Environmental Policy Act checklist and issued a Determination of Nonsignificance for the issuance of the plan on February 23, 2007.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  The 2007 Town of Skykomish General Sewer and Facilities Plan, Attachment A to this ordinance, is hereby approved as a general sewer and facilities plan.
      SECTION 2.  As a condition of the ordinance, that portion of the pipeline which traverses unincorporated King County will be tightlined (preclude future connections) to prohibit connections to the forced main to comply with King County Comprehensive Plan Policy F-249 and K.C.C. 13.23.132.
