STATEMENT OF FACTS:
1. A notice of intention proposing the annexation of approximately 45 acres of land into the Sammamish Plateau water and sewer district, known as Mystic Lake Annexation, for the purpose of providing water and sewer service was filed with the county council on January 9, 2009.
2. The Sammamish Plateau water and sewer district has found the petition for transfer to be sufficient and has concurred with the proposed transfer in Resolution No. 3773, passed on December 15, 2008.
3. The Sammamish Plateau water and sewer district filed a determination of nonsignificance on the proposed annexation dated November 12, 2008.
4. The utilities technical review committee recommended county council approval of the proposed annexation, conditioned upon submittal to the utilities technical review committee by the Sammamish Plateau water and sewer district of an amendment to its sewer plan to include the subject annexation within its planning jurisdiction.
5. The county council held the legally required public hearing and has considered the criteria in RCW 57.02.040.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. The annexation of approximately 45 acres of land into the Sammamish water and sewer district for the purpose of providing water and sewer service described in Attachment A to this ordinance is approved, conditioned upon the submittal by the Sammamish Plateau water and sewer district of an amendment to its sewer plan to include such annexation within its planning jurisdiction to the utilities technical review committee by no later than December 31, 2009. Approval of this proposed annexation is consistent with RCW 57.02.040.
