STATEMENT OF FACTS:
1. The Lake Walker Water Association (Lake Walker) has filed an application for a franchise in council district 9 to operate and maintain a water system to serve nine single family residences.
2. The Lake Walker Water Association is a Group B public water system approved for nine service connections.
3. Lake Walker is an existing system with water lines that have been in place for the past thirty years.
4. Three of the water lines run through East Lake Walker Drive S.E., a King County right-of-way.
5. The Lake Walker Water Association is applying for a franchise in order to meet current state and county requirements regarding water utilities within county right-of-way.
6. The utilities technical review committee ("UTRC") has confirmed with the Seattle-King County department of public health that Lake Walker has met the requirements of a small water system.
7. The UTRC has reviewed and concurs that Lake Walker's application for a right-of-way franchise is consistent with chapter 246-293 WAC, King County Board of Health Code chapter 12.28 and K.C.C. chapters 6.27 and 13.24.
8. The application has been referred to the relevant county departments for review.
9. The King County executive has recommended approval of the franchise.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. The granting of a franchise to the Lake Walker Water Association to operate and maintain a water system within King County is hereby approved. The King County executive is authorized to enter into and execute the water system franchise, which by this reference is fully incorporated herein. Said franchise shall include all of the general and special conditions required by the county.
