STATEMENT OF FACTS
1.  Pursuant to King County Motion _______, a public hearing was held on _________, 2008, on the petitions of property owners within the district to dissolve the road improvement district created to improve certain streets.
2.  Notice of the hearing was duly published and mailed to each property owner pursuant to the requirements of RCW 36.88.050.
3.  All written and verbal protests were considered.
4.  It is hereby found that the petitions, including all additions thereto and withdrawals there from made prior to 5:00 p.m. of the business day before the hearing, are sufficient.
5.  It is further found that all requirements of RCW 36.88.050 and King County Motion _______ have been satisfied.
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  There is hereby dissolved a road improvement district in King County known and designated as “King County road improvement district no.133” ("RID 133"), as created by King County council Ordinance 15058.  The district includes all the territory shown in Attachment A to this ordinance - RID 133 Boundary Map.
      SECTION 2.  It is hereby found that the plan for improvement and construction of RID 133 is not feasible due to increased costs associated with necessary public safety improvements and for compliance with subsequent environmental and storm water regulations, in that the costs to property owners within the district would be overly burdensome, and that the cost of the improvement exceeds the benefits to be derived from the improvement by the properties in RID 133.
      SECTION 3.  The director of the department of transportation is hereby authorized and directed to tabulate costs and expenses for preliminary engineering and administration in conjunction with the work done to date.  The director is further authorized and directed to recover costs and expenses for this project from the RID guaranty fund.
      SECTION 4.  The assessment roll for RID 133, set at $461,066.94 total, or $5,361.24 per property, is hereby rescinded in full.  All liens and encumbrances associated with RID 133 shall be removed from the subject properties.
      SECTION 5.  It is the intention of the King County council that any costs incurred to date for preliminary engineering and right-of-way acquisition will be applied to any road improvement district created in the future for the improvement of any portion of an improvement included in RID 133 to the extent such costs are for work that benefits such later improvements.
