A MOTION declaring the intention of the King County Council to dissolve King County road improvement district no. 133 and set the date for a public hearing.

WHEREAS, King County Ordinance 15058, passed by the King County council on November 8, 2004, established King County road improvement district no. 133 ("RID 133") and confirmed the final assessment roll for the improvement of NE 52nd Street, and
WHEREAS, due to increased costs as a result of needed safety improvements, relocation of utilities, current code requirements and the costs associated with acquiring land for drainage facilities, the current estimated cost of the improvement exceeds the benefits to be derived from the improvement by the properties in RID 133, together with county participation, and
WHEREAS, a petition has been filed by property owners constituting eighty-five percent of the linear front footage and eighty-three percent of the area within the boundary of the improvement requesting dissolution of the road improvement district;
NOW, THEREFORE, BE IT MOVED by the Council of King County:
A. The council hereby states its intention to dissolve RID 133, and shall make void the original assessment and the subsequent liens against the properties within the district.
B. It is the intention of the King County council that all costs incurred to date for RID 133 such as, but not limited to, preliminary engineering and administration will be reimbursed by the RID guaranty fund.
C. All persons who wish to object to or to otherwise be heard on the dissolution of RID 133, are hereby notified to appear and present their objections or testimony at an open public meeting of the King County council to be held in Room 1001 of the King County Courthouse, Seattle, Washington, at 1:30 pm on the 9th day of June, 2008. At such time and place, the council intends to hear such objections and testimony and to act on the intentions set forth herein.
