Title
A MOTION establishing the due date for the next Regional Wastewater Services Plan comprehensive review report.
Body
WHEREAS, the King County council adopted the Regional Wastewater Services Plan ("RWSP") by Ordinance 13680 on November 23, 1999, adding a new chapter to the King County Code, K.C.C. chapter 28.86, and
WHEREAS, the RWSP is an amendment to the King County Comprehensive Water Pollution Abatement Plan and serves as the policy basis for providing wastewater management services to the King County wastewater service area through 2030 and beyond, and
WHEREAS, the King County council amended Ordinance 13680 by adoption of Ordinance 15384 in March 2006 to eliminate redundancies in RWSP reporting requirements, consolidate reporting requirements into fewer, but more comprehensive reports, adjust due dates to reflect availability of information, and added a new section on RWSP reporting policies to K.C.C. chapter 28.86, and
WHERE, Ordinance 15384 and K.C.C. 28.86.165 provide direction on the contents and frequency of RWSP comprehensive review reports, calling for the King County executive to submit the second RWSP comprehensive review report in September 2007, and that subsequent reports be prepared every three to five years as established by the council and regional water quality committee ("RWQC") following their review of the September 2007 report, and
WHEREAS, in accordance with Ordinance 13680, the executive submitted the first RWSP comprehensive review, covering RWSP policy implementation from 1999 through 2003, to council and RWQC in April 2004, and
WHEREAS, in accordance with Ordinance 15384 and K.C.C. 28.86.165, the executive submitted the second RWSP comprehensive review, covering RWSP policy implementation from 2004 through 2006, to council and RWQC in September 2007, and
WHEREAS, Ordinance 15384 and K.C.C. 28.86.165 provide guidance that the specific due date of the next comprehensive review be based upon the availability of necessary information, the completion of key milestones and the time needed to collect and analyze data, and
WHEREAS, the executive, through the transmittal letter that accompanied the second RWSP comprehensive review report, recommended that the next RWSP comprehensive review be submitted in September 2012 to cover RWSP policy implementation from 2007 through 2011 based on availability of information and completion of key milestones that are anticipated in 2010 and 2011, and
WHEREAS, the anticipated key milestones in 2010 and 2011 include completion of Brightwater construction and startup, completion of the second combined sewer overflow control program review, near completion of the infiltration and inflow initial projects and publication of Puget Sound Regional Council's updated population and employment growth forecast based on Puget Sound Regional Council's analysis of the 2010 census, and
WHEREAS, establishing September 2012 as the due date for the next RWSP comprehensive review report provides time for executive staff to analyze the results associated with these key milestones and determine the effects, if any, on RWSP planning assumptions and facility needs, and include this information in the next RWSP comprehensive review report, and
WHEREAS, in accordance with Ordinance 15384 and K.C.C. 28.86.165, the executive shall continue to provide RWSP annual reports that are due each year in September to cover the previous year's implementation of the major elements of the RWSP to council and RWQC;
NOW, THEREFORE BE IT MOVED by the council of King County:
That the executive submit the next RWSP comprehensive review report, covering
RWSP policy implementation from 2007 through 2011, to council and RWQC in September 2012.
