AN ORDINANCE relating to a marine division proviso; amending the 2008 Budget Ordinance, Ordinance 15975, Section 112, as amended,; and declaring an emergency.

BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. Findings:
A. On November 13, 2007, the King County Ferry District board passed Resolution FD2007-06, adopting the district's budget and authorizing a property tax levy to implement passenger-only ferry service in King County. Within the findings, the resolution stated:
"It is anticipated that King County, with its expertise related to ferry service programs and projects, will be called upon to provide the necessary staffing for implementation of the district work plan. The working relationship between the district and King County will be provided for in an interlocal agreement that will be adopted by a separate resolution of the board of the ferry district."
B. On November 19, 2007, the metropolitan King County council passed Ordinance 15973 establishing a marine division within the department of transportation. The marine division is responsible for the administration, maintenance and operation of passenger ferry service on a contract basis for the King County Ferry District.
C. On November 19, 2007, the metropolitan King County council passed Ordinance 15975 appropriating a budget of $1,451,779 to the marine division. The ordinance contains a proviso restricting the expenditure or encumbrance of marine division appropriations until an interlocal agreement has been executed between the county and the King County Ferry District, relating to contract services for county implementation of the district ferry work program and capital program.
D. Over the last four months, the county and the King County Ferry District have worked collaboratively to develop an interlocal agreement for implementation of ferry services. The two parties are still in the process of negotiating the interlocal agre...
