STATEMENT OF FACTS
1.  On April 7, 2006, the city of Redmond, King County and the Quadrant Corporation entered into a settlement agreement to resolve the issues raised in the appeal of the Redmond Ridge East Urban Plan Development ("UPD") permit and preliminary plat application.
2.  One of the issues addressed in the agreement was the improvement of the intersection of NE 124th Street and State Route 202 (Redmond-Woodinville road).  At the time of the agreement, the right-of-way where the improvement was proposed was located in unincorporated King County, abutting the north corporate boundary of the city of Redmond.
3.  The King County executive and Redmond's city mayor agreed that, if the Transportation Improvement Board ("TIB") funding for the intersection improvement was approved, the executive and the mayor would recommend to their respective councils that the boundary between the city and the county in the location of the proposed improvement be moved from the south side of NE 124th Street right-of-way to the north side, thereby placing that portion of the right-of-way within the corporate limits of the city.  After the boundary revision, the city of Redmond would have the responsibility for the construction of the improvement.   
4.  These settlement agreement provisions were incorporated in section 2.10.6 of the Redmond Ridge East UPD permit, which was approved by the King County council in ordinance 15565 on August 21, 2006.
5.  RCW 35.21.790 and 35A.21.210 authorize King County and the city of Redmond to agree to revise any part of the corporate boundary of the city that coincides with the centerline, edge, or any portion of a county road-right-of way by substituting therefore a right-of-way line of the same county road so as fully to include that segment of the county road within the corporate limits of the city.
6.  The corporate boundary revision is effective upon approval by county ordinance.  Such a boundary revision is not subject to potential review by the boundary review board.
7.  The TIB awarded a grant to the city of Redmond for the intersection improvement at NE 124th Street and Redmond-Woodinville road, as described in the settlement agreement and the UPD permit.
8.  The city of Redmond enacted ordinance number 2330 effective March 31, 2007, to revise its corporate boundary at NE 124th Street subject to approval by the King County council, as contemplated in the settlement agreement and the UPD permit.
9.  It is in the city of Redmond and King County's best interest to have this right-of-way under the city of Redmond's jurisdiction so that the city of Redmond may accomplish the intersection improvement described in the settlement agreement and the UPD permit.
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  The revision of the corporate boundary of the city of Redmond to
 
include the section of NE 124th Street right-of-way legally described as set forth in Attachment A to this ordinance is hereby approved.
