AN ORDINANCE authorizing the King County executive to enter into an interlocal transfer agreement for an approximately thirty-acre portion of Soaring Eagle park, formally known as Section 36 park, between King County and the city of Sammamish.

BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. Findings:
A. K.C.C. 4.56.140 authorizes the county to dispose of real property to another governmental agency by negotiation and upon such terms as may be agreed upon and for such consideration as may be deemed by the county to be adequate.
B. Consistent with the parks and recreation division's Business Transition Plan and the focus on partnering with groups and jurisdictions to provide additional recreation opportunity, this transfer will result in the development of much needed recreational faculties in an area currently underserved.
C. King County and the city of Sammamish have agreed to terms of an interlocal agreement for the transfer of a portion of Soaring Eagle park to the city.
D. The recitals in the agreement set forth relevant facts supporting and explaining the terms of the transfer.
E. King County and the city have agreed that the transfer will take place within thirty days following execution of the interlocal agreement by both parties.
F. Transfer of a portion of the park will enable development of active recreational facilities to meet a need that is currently underserved.
G. The transfer of a portion of Soaring Eagle park to the city of Sammamish is not intended to set a policy precedent for the transfer of parks in rural unincorporated King County that are not also located within a potential annexation area to other jurisdictions or organizations.
H. The transfer of a portion of Soaring Eagle park to the city of Sammamish is intended to fulfill the original intent to develop a limited amount of active recreation at Soaring Eagle park as noted in Motion 9714, the Section 36 progra...
