STATEMENT OF FACTS:
1. Under Ordinance 19165, King County entered into the Puget Sound Emergency Radio Network Operator Interlocal Cooperation Agreement ("PSERN Operator ILA") with the cities of Auburn, Bellevue, Federal Way, Issaquah, Kent, Kirkland, Mercer Island, Redmond, Renton, Seattle and Tukwila.
2. PSERN Operator ILA creates a new separate governmental agency under RCW 39.34.030(3)(b) to be called the Puget Sound Emergency Radio Network Operator ("PSERN Operator"). The PSERN operator will be organized as a nonprofit corporation under chapter 24.06 RCW to assume ownership and control of the Puget Sound Emergency Radio Network ("PSERN") system following implementation of the system and full system acceptance.
3. The PSERN Operator will be established approximately eighteen months before the anticipated date for full system acceptance. That will require the filing of incorporation documents with the Washington Secretary of State, the designation of governing board members by the parties to the PSERN Operator ILA and agreement on and filing of other documents such as bylaws. The goal is to have the PSERN Operator ready to assume these functions upon full system acceptance.
4. An executive director must be hired to run the PSERN Operator's day-to-day business to include the hiring of staff to operate, maintain, monitor, repair, update and upgrade the PSERN system.
5. The county is willing to enter into an agreement or agreements with the PSERN Operator for a county employee to serve as the PSERN Operator executive director and for other county employees to serve as the PSERN Operator staff. The county is fu...
