Title

AN ORDINANCE revising the corporate boundary of the city of Covington to include the unincorporated portion of Southeast 240th Street as provided for in RCW 35A.21.210.

STATEMENT OF FACTS:

1.  It is in the county's best interest to allow cities within King County to manage the entirety of roads that coincide with the city's boundaries.  RCW 35A.21.210 provides the mechanism to allow cities with King County to adjust their boundaries to fully include roads on the cities' boundaries within the city.  RCW 35A.21.210 provides that "[t]he governing bodies of a county and any code city located therein may by agreement revise any part of the corporate boundary of the city which coincides with the centerline, edge, or any portion of a public street, road or highway right-of-way by substituting therefor a right-of-way line of the same public street, road or highway so as fully to include or fully to exclude that segment of the public street, road or highway from the corporate limits of the city.

2.  Revision of the corporate boundary of a city is effective upon approval by the city council and the county legislative authority as provided for in RCW 35A.21.210.

3.  King County has jurisdiction over Southeast 240th Street from the intersection of the west margin of 180th Avenue Southeast to the western edge Covington Community Park (parcel number 2422059182) and approximately 20 feet wide of the right-of-way from the west margin of 180th Avenue Southeast to the western edge of the Covington Aquatic Center (parcel number 1822069168) and 20 feet wide of the right-of-way from the eastern edge of the Covington Aquatic Center to the city boundary.

4.  It is in the city and the county's best interest to have the county right-of-way portion of Southeast 240th Street under the city's jurisdiction so that the city may provide local services to its residents including the maintenance and operation of the public right-of-way.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  Findings:

                     A.  A portion of the corporate boundary of the city of Covington currently extends along the south margin of the right-of-way of Southeast 240th Street and another portion of the corporate boundary extends within the right-of-way of SE 240th Street.  Approximately 0.42 miles of the Southeast 240th Street is located within unincorporated King County of which approximately 0.17 miles is full width of the right-of-way and approximately 0.25 miles is partial width of the right-of-way.

                     B.  The Covington city council approved city of Covington Ordinance No. 23-2017 to revise the city's corporate boundary at Southeast 240th Street to include the portion of approximately 0.42 miles of public right-of-way currently within unincorporated King County into the corporate limits of the city.

                     SECTION 2.  The revision of the corporate boundary of the city of Covington to include the portion of Southeast 240th Street public right-of-way currently within

unincorporated King County, legally described as set forth in Attachment A to this ordinance, is hereby approved.
