Title

AN ORDINANCE relating to an easement for road and utility purposes, over two discrete portions of the East Lake Sammamish Trail Corridor, within council district three.

Body

STATEMENT OF FACTS:

1.  The facilities management division received a request for an easement over two discrete portions of the East Lake Sammamish Trail Corridor located adjacent to the intersection at NE 65th Street and East Lake Sammamish Parkway, located in council district three, on August 18, 2016.

2.  In accordance with K.C.C. 4.56.115.A, the county is authorized to grant easements.  Under that subsection, a permanent easement granted by the county is subject to prior approval by ordinance when the value of the easement would exceed fifty thousand dollars.

3.  The East Lake Sammamish Trail is a railbanked corridor under the National Trails System Act amendments of 1983, also known as the Rails-to-Trails Act, 16 U.S.C. Section 1247(d).

4.  The applicant provided an appraisal that established the fair market value of the easement.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  The council authorizes the executive to grant to the city of Redmond an easement for road and utility purposes, substantially in the form of Attachment A to this ordinance, but only after the department of natural resources and parks approves the design and construction process for the Plans and City Project, as

those terms are defined in the easement.  Subsequent to that approval, the executive may take all actions necessary to execute and implement the easement.
