AN ORDINANCE authorizing the vacation of a portion of 314th Way SE, dedicated as Railroad Avenue, File V-2697, Petitioners:  James and Kathleen Pryor.

Body

STATEMENT OF FACTS:

1.  A petition has been filed requesting vacation of a portion of 314th Way SE dedicated as Railroad Avenue, as shown on the Plat of the Townsite of Cumberland, hereinafter described.

2.  The department of transportation notified our standard stakeholders for review, including utility companies serving the area. The department of transportation was advised that no easements were needed.

3.  The department of transportation considers the subject portion of right of way useless as part of the county road system and believes the public would benefit by the return of this unused area to the public tax rolls.

4.  The department of transportation records indicates that King County has not expended public funds for the acquisition or maintenance of the subject portions of 314th Way SE dedicated as Railroad Avenue right-of-way.

5.  The right-of-way was classified as "C-Class" and, in accordance with K.C.C. 14.40.020, the compensation due to King County was based on fifty percent of the assessed value of the subject right-of-way, which was determined from records of the department of assessments at $1,884.76. King County is in receipt of this amount from the petitioner.

6.  Due notice was given in the manner provided by law and a hearing was held by the office of the hearing examiner on the 10th day of April 2017.

7.  In consideration of the benefits to be derived from the subject vacation, the council has determined that it is in the best interest of the citizens of King County to grant said petition.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  The council, on the effective date of this ordinance, hereby vacates and abandons the portion of 314th Way SE dedicated as Railroad Avenue right-of-way as conveyed to King County by the recording of the Plat of the Townsite of Cumberland, recorded on November 2, 1910, in Volume 19 of Plats, Page 52, records of King County, Washington, as described below:

Those portions of 314th Way SE dedicated as Railroad Avenue in King County Washington, described as follows:

All that portion of 314th Way SE dedicated as Railroad Avenue situate in the Northwest Quarter of Section 28, Township 21 North, Range 7 East, Willamette Meridian, King County, Washington as shown in the Plat of the Townsite of Cumberland, recorded in Volume 19 of Plats, page 52, records of King Count, Washington abutting and adjacent to Lots 13 and 14 of said Plat of the Townsite of Cumberland.

Containing an area of 901.80 square feet, more or less.
