AN ORDINANCE approving an application for renewal of a franchise with King County Water District 123, for use of certain road rights-of-way in unincorporated King County for the construction and maintenance of water distribution system facilities.

STATEMENT OF FACTS:

1.  On February 13, 2020, King County Water District 123 filed an application to renew its nonexclusive franchise for the installation, operation and maintenance of water distribution system facilities, to include an expanded franchise area in unincorporated King County.

2.  The application was referred to the facilities management division of the department of executive services for development of the terms and conditions for a right-of-way franchise with King County Water District 123, in accordance with K.C.C. 6.27.050.A.1.

3.  The application has been reviewed by the road services division of the department of local services, in accordance with K.C.C. 6.27.050.A.2.

4.  The application was submitted to and approved by the utilities technical review committee, in accordance with K.C.C. 6.27.050.B.

5.  The King County executive recommends approval of the franchise and hereby refers such to the King County council for hearing and decision, in accordance with K.C.C. 6.27.050.A.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  The metropolitan King County council, having determined that the application by King County Water District 123 meets the criteria for granting of a right-of-way franchise and that the grant is in the best interests of the public, does hereby

approve the terms and conditions contained in the attached franchise agreement and authorizes the King County executive to execute a substantially similar agreement.
