Title
A MOTION relating to the appointment of Robert Abbott to fill a vacancy on the Sammamish Plateau water and sewer district's board of commissioners.
Body
WHEREAS, Sammamish Plateau water and sewer district is a special purpose water and sewer district, governed by Title 57 RCW, providing water and wastewater services to an area in King County known as the Sammamish plateau, and
WHEREAS, Sammamish Plateau water and sewer district is governed by a five-member board of commissioners, and each commissioner is normally elected to serve a six year term, and
WHEREAS, RCW 42.12.070(1) provides that, "Where one position is vacant, the remaining members of the governing body shall appoint a qualified person to fill the vacant position," and
WHEREAS, position three on the Sammamish Plateau water and sewer district board of commissioners became vacant on January 5, 2009, and the remaining members of the governing body were unable to reach a consensus, and
WHEREAS, RCW 42.12.070(4) provides that, "If a governing body fails to appoint a qualified person to fill a vacancy within ninety days of the occurrence of the vacancy, the authority of the governing body to fill the vacancy shall cease and the county legislative authority of the county in which all or the largest geographic portion of the city, town, or special district is located shall appoint a qualified person to fill the vacancy," and
WHEREAS, King County is the legislative authority of the county for the Sammamish Plateau water and sewer district and, in accordance with RCW 42.12.070(5), is authorized to appoint, within one hundred and eighty days of the occurrence of the vacancy, a qualified person to fill the vacancy, and
WHEREAS, King County's one-hundred-eighty-day time limit expires July 4, 2009, and the authority to fill the vacancy would thereafter reside with the governor of the state of Washington unless King County acted to fill the vacancy before the governor's action, and
