A MOTION approving the office of the public defender's report and the proposed modification to the payment procedure for persistent offender cases.

      WHEREAS, the King County council included an expenditure restriction within the office of the public defender's section of the 2008 Budget Ordinance, which is Ordinance 15975, Section 52, and
      WHEREAS, the expenditure restriction requires the office of the public defender to continue the status quo reimbursement method for persistent offender cases "until such a time as the county council has approved, by motion, a change to the existing model," and
      WHEREAS, the office of the public defender has prepared a report detailing the financial impacts of any proposed change on each defender agency and define or detail any expected impact on the resources available for the defense of the accused, and
      WHEREAS, the office, in completing the study, has solicited input from the defender associations and from the King County Bar Association, and
      WHEREAS, the executive has transmitted to council a report complying with the requirements of the expenditure restriction, and
      WHEREAS, the proposed contract changes regarding reimbursement for persistent offender cases does not change the existing Public Defender Payment Model adopted by Motion 12160;
      NOW, THEREFORE, BE IT MOVED by the King County Council
      The office of the public defender's report regarding proposed modifications to the contract procedure for payment for persistent offender cases is approved.
