STATEMENT OF FACTS:
1. King County has adopted a comprehensive plan that includes wastewater policies in its provisions for facilities and services for the rural area. Public sewer expansions shall not occur in the rural area except where needed to address specific health and safety problems threatening the existing uses of structures or the needs of public schools or public school facilities, consistent with the paramount duty of the state to make ample provision for the education of all children residing within its borders. Public sewers may be extended pursuant to the comprehensive plan policy F-249 only if they are tightlined and only after a finding is made by King County that no reasonable alternative technologies are technologically or economically feasible and that an on-site sewer disposal system for the public school or public school facility would not protect basic public health, safety and the environment during the use of this site for a school or school facility.
2. The Wilder Elementary School has been operating for nineteen years, serves grades kindergarten through sixth, and has the capacity to serve approximately five hundred fifty students and staff. The school is in the rural area two thousand six hundred feet west of the urban growth boundary, and presently served by an on-site holding tank that is failing.
3. The city of Redmond ("the city") and the Lake Washington School District ("LWSD") have requested King County approve the connection of the Wilder School to the sewer system operated by the city of Redmond.
4. King County approved the existing City of Redmond General Sewer Plan on January 15, 1998, in Ordinance 12964.
5. The city of Redmond filed an amendment to its general sewer plan in March 2009. Upon the filing of the sewer plan amendment with the utilities technical review committee (...
