AN ORDINANCE relating to the removal of approximately 12 acres of land from the city of Issaquah's sewer service area and annexation into the Sammamish Plateau water and sewer district, known as the NE 1st & Juniper Annexation, for the purpose of sewer service.

STATEMENT OF FACTS:
1. A notice of intention proposing the removal of approximately 12 acres of land, from the city of Issaquah's sewer service area and annexation into the Sammamish Plateau water and sewer district, known as the NE 1st & Juniper Annexation, for the purpose of sewer service was filed with the county council on August 25, 2022.
2. The NE 1st & Juniper Annexation area is within the city of Issaquah's sewer service area.
3. The NE 1st & Juniper Annexation area is on the boundary of the district's and the city's sewer service boundaries.
4. The Sammamish Plateau water and sewer district provides sewer service to a portion of the parcels in the NE 1st & Juniper Annexation area.
5. The city of Issaquah and the Sammamish Plateau water and sewer district entered into an interlocal agreement in 2017 to identify the district as the most logical long-term provider of sewer service to the area.
6. The Sammamish Plateau water and sewer district filed a determination of nonsignificance on the proposed transfer dated March 9, 2022.
7. The Sammamish Plateau water and sewer district has approved the proposed transfer in Resolution No. 5118, passed on July 25, 2022.
8. The utilities technical review committee reviewed the Sammamish Plateau water and sewer district 2013 sewer comprehensive plan and found that plan met the criteria for approval. The county approved the most recent plan for the Sammamish Plateau water and sewer district in 2015, as part of Ordinance 18061.
9. The county council held the legally required public hearing and has considered the criteria in RCW 57.02.040.
