STATEMENT OF FACTS
1. The King County council, on November 23, 1998, by Ordinance 13340 did adopt the annual budget and program, and did provide therein for a transportation program that included the replacement of Mount Si Bridge 2550A.
2. The Replacement Design Memorandum dated April 2001 recommends certain design criteria and alignment alternatives for the Mount Si Bridge 2550A replacement. The State Environmental Policy Act (Chapter 43.21C RCW) requires the county to evaluate the alignment alternatives before deciding on the final alignment of the bridge replacement.
3. It is necessary to obtain property rights to enter private property to conduct topographical surveys; identify, locate and survey environmentally sensitive areas; survey potential wetland resource areas; conduct geotechnical soil borings and studies; and all other assessments and testing necessary for compliance with the State Environmental Policy Act and other applicable laws, regulations and requirements in order to evaluate the alignment alternatives for the bridge replacement.
4. The King County council on November 19, 2001, by Ordinance 14265 did adopt the 2002 budget and program and did provide therein for a transportation program. The capital budget and program provides for the acquisition of land necessary for the replacement of the Mount Si Bridge 2550A, Right-of-Way No. 9-1998-018.
5. In order to acquire the property and property rights required to accomplish the evaluation of the alternative alignments for the replacement of Mount Si Bridge 2550A, it is necessary for King County to condemn certain lands, property, property rights, and/or rights in property for road purposes as hereinafter more particularly set forth.
