AN ORDINANCE adding K.C.C. Title 7 parks and recreation citations to the list of waived fees for appeals of agency decisions to the hearing examiner's office; and amending Ordinance 18230, Section 77, as amended, and K.C.C. 4A.780.010.

STATEMENT OF FACTS:
1. K.C.C. 4A.780.010 requires the collection of fees by the hearing examiner for appeals of agency decisions and identifies several exceptions to the appeal fee.
2. In 2024, K.C.C. Title 7 was amended to establish that appeals of civil infractions are to be reviewed by the hearing examiner.
3. The parks and recreation division has established a park rules safety and education campaign for enforcement of parks and trail rules in K.C.C. Title 7.
4. The parks and recreation division and the hearing examiner have determined that the mandatory two-hundred-fifty-dollar appeal fee established in K.C.C. 4A.780.010 may impact the due process rights of certain appellants by limiting their access to an appeal due to the notably higher cost of appeals than the penalty for many civil infractions.
5. The parks and recreation division and the hearing examiner wish to have K.C.C. Title 7 added to the list of appeals that have their hearing examiner appeal fees waived.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. Ordinance 18230, Section 77, as amended, and K.C.C. 4A.780.010 are hereby amended to read as follows:
A. Except as otherwise provided in subsection B. of this section, the fee for filing an appeal to the office of the hearing examiner under K.C.C. 20.22.080 is two hundred fifty dollars.
B.1. The fee for filing an appeal to the office of the hearing examiner under K.C.C. 20.22.080, of a permit fee estimate and billing under K.C.C. 27.02.040.D., is fifty dollars.
