STATEMENT OF FACTS:
1. A petition has been filed requesting vacation of a portion of Avondale Road NE and NE Woodinville-Duvall Road right-of-way.
2. The department of local services's records indicate that Avondale Road NE and NE Woodinville-Duvall Road are open and maintained King County road right-of-way.
3. The department of local services's notified utility companies serving the area and King County departments of the proposed vacation and has been advised that Puget Sound Energy, Comcast, Frontier and the King County Metro transit department have infrastructure in the vacation area.
4. Petitioner proposed an exchange of real property as compensation for the vacation area pursuant to K.C.C. 14.40.020.
5. The department of local services considers the subject portion of right-of-way useful as part of the county road system and recommends denial of the petition under RCW 36.87.010.
6. Due notice was given in the manner provided by law. The office of the hearing examiner held the public hearing on ________, ______, 2021.
7. As detailed in the hearing examiner's ___________, ____ 20__, recommendation, the hearing examiner concluded that the road segment subject to this petition is useful as part of the King County road system. Therefore, the hearing examiner recommends that the council deny the vacation petition and reject the petitioner's request to accept the conveyance of real property as compensation for the vacation area.
8. In consideration of the recommendations of the county road engineer and hearing examiner, the council has determined that it is in the best interest of the citizens of King County to deny said petition.
