AN ORDINANCE authorizing the King County executive to enter into an interagency agreement between King County and the city of Burien regarding design, construction, ownership, operation and maintenance of the portion of Segment B of the Lake to Sound trail that is within the city.

STATEMENT OF FACTS:
1. King County and the city of Burien are working collaboratively to construct what is known as Segment B of the Lake to Sound trail, a segment of trail along Des Moines Memorial Drive that will extend from South Normandy Road in Burien to 156th Way in SeaTac.
2. Segment B will be a critical segment of the larger regional Lake to Sound trail, extending from the southern end of Lake Washington to Puget Sound as part of the transportation corridor, and will provide significant recreational and health benefits to residents of cities and King County.
3. Under RCW 36.89.050, King County is authorized to construct a park or recreational facility and transfer to a city the county's ownership interest and operation and maintenance obligations for the facility, but only if the city continues to use the facility for the same purposes or conveys other equivalent facilities to King County in exchange thereof.
4. The trail improvements for Segment B are being constructed primarily on city of Burien rights-of-way. Therefore, following construction, King County will convey Segment B of the trail to the city of Burien for long-term operation and management. The city will own this facility and operate and maintain it for use by the general public as a regional trail.
5. King County received one million four hundred sixty-four thousand seventy-two dollars in Federal Highway Administration grant funds and is also using county levy moneys, in accordance with Ordinance 15760, for the design and construction of Segment B.
