Title

AN ORDINANCE denying the vacation of a portion of 45th Ave S, V-2759; Petitioners:  Terry L. Swanson and Dean B. Swanson.

STATEMENT OF FACTS:

1.  A petition has been filed requesting vacation of a portion of 45th Ave S in the Renton area of unincorporated King County, hereinafter described.

2.  The department of local services notified utility companies serving the area and King County departments of the proposed vacation.  No utility or agency requested an easement over the vacation area.

3.  The department of local services’ records indicate that this segment of right of way is an unopen and unmaintained right of way dedicated in the 1910 Plat Jovita Addition.

4.  The department of local services considers the subject portion of right of way useless as part of the county road system.  However, the subject portion of right of way is a platted public right of way abutting a body of fresh water, Trout Late, and the department of local services recommends denial of the vacation petition pursuant to RCW 36.87.130.

5.  Due notice was given in the manner provided by law.  The office of the hearing examiner held the public hearing on ________, ______, 2025.

6.  As detailed in the _________, ___, 2025 recommendation, the hearing examiner found that the road segment subject to this petition is useless as part of the King County road system, however vacation is prohibited under RCW 36.87.130 as this segment of road right of way abuts on a body of fresh water.  Therefore, the hearing examiner recommended denial of the vacation petition.

7.  In consideration of the recommendations of the county road engineer and hearing examiner, the council determines that it is in the best interest of the citizens of King County to deny said petition.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  The council, on the effective date of this ordinance, hereby denies

the petition to vacate a portion of 45th Ave S right of way as filed under vacation file V-2759.
