AN ORDINANCE making an emergency appropriation of $19,500 from the DCFM internal service fund balance to the DCFM internal service fund to pay for unbudgeted costs of operating the King County winter shelter, and amending the 2002 Budget Ordinance, Ordinance 14265, Section 108, as amended, and declaring an emergency.

      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  Findings of fact:
A.  The executive did not include funding in the 2002 budget to operate the downtown winter shelter in the King County administration building during the fourth quarter due to the necessity to use the space for staging related to the courthouse seismic project (CSP).
B.  The Yesler building has available space to provide for a winter shelter.
C.  The council has authority to enact an emergency appropriation ordinance as set forth in the King County Charter section 470.20.
D.  The county has recognized the need for and has provided winter shelter for over ten years.
E.  In light of the current economic recession, homelessness is increasing.
F.  There is an immediate and critical need for winter shelter that would reduce public health hazards and the subsequent burden on Harborview medical center.
G.  King County is a general purpose government with major facilities in downtown Seattle.
H.  Winter shelter can be provided at minimal cost using existing county facilities outside of normal business hours.
I. The winter shelter is heavily utilized when available and located near most of King County's homeless people.
J.  The management and security cost for the winter shelter for the remainder of 2002 is $19,500.
      SECTION 2.  Ordinance 14265, Section 108, as amended, is hereby amended by adding thereto and inserting therein the following:
      DCFM - internal service fund - From the DCFM internal services fund balance is appropriated to:
      DCFM internal service fund                                    $19,500
      PROVIDED THAT:
      Of this appropriation, $19,500 shall be spent only on the winter shelter, which shall open on November 18th, 2002.  The winter shelter should be located on the fourth floor of the Yesler building in vacant temporary courtroom spaces constructed for the CSP or the Administration building first floor space adjacent to the lobby currently used for CSP material storage.
      SECTION 3.
      The council finds as a fact and declares that an emergency exists and that the enactment of this ordinance as an emergency ordinance is necessary for the immediate preservation of public peace, health or safety or for the support of county government and its existing public institutions.
