AN ORDINANCE extending the time for filing written confirmations required in Ordinance 14446; and repealing Ordinance 14446, Section 3, and Ordinance 14446, Section 4.

BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. Findings: The council hereby finds the following facts:
A. TCI Cablevision of Washington, Inc., and Tele-Vue Systems, Inc., (franchisees) subsidiary corporations of Tele-Communications, Inc. (TCI), which is now known as AT&T Broadband, LLC (ATTB), provide cable television service in unincorporated King County pursuant to cable television franchises 12132 and 11680, as amended (franchise agreements).
B. In compliance with the franchise agreements, franchisees, TCI and ATTB requested approval of a proposed transfer of parental control of franchisees to a new entity to be known as ATT Comcast Corporation (ATT Comcast).
C. On July 29, 2002, the council passed Ordinance 14446 approving the proposed transfer of parental control conditioned on the written confirmation of ATT Comcast, AT&T Broadband, LLC, ATTB, franchisees, TCI West, Inc., TCI Pacific, Inc., and the applicable bonding company regarding certain provisions of Ordinance 14446.
D. The written confirmations required by Ordinance 14446 were to be filed with the clerk of the council within thirty calendar days of the effective date of Ordinance 14446. Failure to file the written confirmations as required would result in a denial of the proposed transfer as of the enactment date of Ordinance 14446.
E. The effective date of Ordinance 14446 was August 19, 2002. The written confirmations required by Ordinance 14446 were filed with the clerk of the council on October 24, 2002, and are attached to this ordinance. An amended written confirmation letter was filed with the clerk of the council on November 18, 2002.
SECTION 2. Ordinance 14446, Section 3, and Ordinance 14446, Section 4, are each hereby repealed.
SECTION 3. The written confirmations required by Ordinance 14446, as filed with the clerk of the council on October 24, 2002, and November 18, 2002 are accepted.
SECTION 4. The franchisees' request for approval of the transfer of parental control is granted as and the actions taken in this ordinance are retroactive to and shall be
as if all necessary actions were taken as of the effective date of Ordinance 14446, subject to all conditions of Ordinance 14446 that have not been repealed by this ordinance.
