AN ORDINANCE authorizing the vacation of a portion of SE Diamond Drive File V-2452 Petitioner(s): Washington National Golf Club LLC.

1. A petition has been filed requesting vacation of that portion of SE Diamond Drive hereinafter described.
2. The vacation request is part of the Diamond Ridge Estates Division 2 plat alteration application L01ALT02.
3. Utility companies serving the area were not notified because the Diamond Ridge Estates Division 2 plat had not been developed prior to the road vacation petition submittal date.
4. The department of transportation records indicates that King County has not been maintaining SE Diamond Drive. The records indicate that no public funds have been expended for its acquisition.
5. The department of transportation considers the subject portion of the right-of-way useless as part of the county road system and believes the public would benefit by the return of this unused area to the public tax rolls.
6. The right-of-way is classified as D-Class and, in accordance with K.C.C. 14.40.020, the compensation due King County is for the administrative cost of the vacation. King County is in receipt of $200 from the petitioner.
Due notice was given in the manner provided by law and a hearing was held by the office of the hearing examiner on the ____________ day of _____________________, 20___.
In consideration of the benefits to be derived from the subject vacation, the council has determined that it is in the best interest of the citizens of King County to grant said petition.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. The council, on the ____ day of _________________, 2002, hereby vacates and abandons that portion of SE Diamond Drive as conveyed to King County by the recording of Plat Diamond Ridge Estates, Division 2 recorded in Volume 196 of Plats, Pages 1 through 16, records of King County, Washington as described below:
That portion of the SE Diamond Drive right-of-way, as shown on the plat of Diamond Ridge Estates, Division 2, as recorded in volume 196, pages 1 through 16, Auditors file No. 20001010000450, of the records of King County, Washington, from the west right-of-way line of 148th Avenue SE to a point on the centerline of said SE Diamond Drive, said point being 140.00 feet NE of the intersection of SE Diamond Drive and 138th Place SE as measured along said centerline.
