AN ORDINANCE authorizing the executive to execute an amendment extending the term of fiber optic installation and maintenance agreements; authorizing the executive to enter into future project agreements under approved general terms and conditions; and authorizing the executive to execute two project agreements for fiber optic installation and maintenance with the city of Seattle and the Washington state Department of Transportation.

STATEMENT OF FACTS:

1.  Ordinance 12871 authorized the execution of a twenty-year interagency agreement among King County, the city of Seattle, the University of Washington, Seattle Community College District VI, the United States General Services Administration, Seattle Community Colleges, King County Library, and Seattle School District ("the participating agencies").

2.  The interagency agreement set general terms and conditions to be used for shared fiber optic network installation and maintenance projects ("the general terms and conditions").

3.  Ordinance 12871 further authorized the executive to a execute a specific project services addendums for fiber optic installations and maintenance from the Seattle Municipal Building to the Seattle Center using the general terms and conditions.

4.  Since 1997, the county has executed other project services addendums using the general terms and conditions and committing the county to pay its proportionate share of capital and maintenance costs.

5.  The cost of maintenance owed by the county under executed project services addendums is on average ten thousand dollars per year but generally continues beyond a single appropriation period.

6.  In 2018, a proposed amendment to the general terms and conditions was presented to the participating agencies to extend all project services addendums for an additional ten years.

7.  It is in the best interests of the residents of King County to extend the executed project services addendums for an additional ten years.

8.  The general terms and conditions may be used for future shared fiber optic network installation and maintenance projects as determined by the executive and the participating agencies.

9.  It is in the best interests of the residents of King County to authorize the executive to execute future project services addendums using the general terms and conditions without requiring council approval for each project agreement even where the agreement commits the county to expend funds for maintenance beyond a current appropriation period.

10.  Addendum #34 covers the fiber cable installation supporting Washington state Department of Transportation ("WSDOT") and the King County Metro transit department ("KCM") for the 2016 WSDOT Tunnel project.  The work includes the completion of the fiber installation between SR99 Tunnel South Operations Building to the Capitol Hill Radio Tower and the KCM South Access Cabinet Project, along with changes in cost allocation between SDOT and KCM.  It shall be noted that addendum #34, also is extending the end date of Addendum #27 to December 31, 2019, to enable WSDOT to complete payment to city of Seattle for the completed work.

11.  Addendum #36 is also related to the WSDOT Tunnel Project, specifically installing fiber cabling between Pier 48 and Coleman Dock, temporarily rerouting existing fiber optic cabling for the Seattle Department of Transportation Waterfront Project, the permanent reroute of King County fiber path between King Street Center and Coleman Dock by December 15, 2018, and the removal of fiber connecting WSDOT emergency gates by January 11, 2019.

12.  It is in the best interests of the residents of King County to enter into the Project Services Addendum in Attachment B to this ordinance.

13.  It is in the best interests of the residents of King County to enter into the Project Services Addendum in Attachment C to this ordinance.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  A.  The council finds and determines it is appropriate and in the best interests of the residents of King County to extend the term of all project services addendums executed using the general terms and conditions to be used for shared fiber optic network installation and maintenance projects ("the general terms and conditions") for an additional ten years as described in Attachment A to this ordinance.

                     B.  The council finds and determines it is appropriate and in the best interests of the residents of King County to authorize the executive to execute future shared fiber optic network installation and maintenance project agreements using the general terms and conditions without council approval provided the commitment to expend funds beyond a current appropriation period is limited to maintenance.

                     C.  The council finds and determines it is appropriate and in the best interests of the residents of King County for the county to enter into a Project Services Addendum agreement based on the general terms and conditions with the city of Seattle and the Washington state Department of Transportation for the fiber optic installation and maintenance as described in Attachment B to this ordinance.

                     D.  The council finds and determines it is appropriate and in the best interests of the residents of King County for the county to enter into a Project Services Addendum Agreement based on the General Terms and Conditions with the city of Seattle and the Washington state Department of Transportation for the fiber optic installation and maintenance as described in Attachment C to this ordinance.

                     SECTION 2.  A.  The executive is hereby authorized to execute the extension amendment to the general terms and conditions in substantially the form provided in Attachment A to this ordinance.

                     B.  The executive is hereby authorized to execute all project agreements determined by the executive to be in the best interests of the county utilizing the general terms and conditions without further council approval provided the only commitment to expend funds beyond the then current appropriation period is for maintenance.

                     C.  The executive is hereby authorized to execute the Project Services Addendum in substantially the form provided in Attachment B to this ordinance.

                     D.  The executive is hereby authorized to execute the Project Services Addendum in substantially the form provided in Attachment C to this ordinance.
