Title
AN ORDINANCE authorizing the King County executive to enter into an interlocal agreement with the West Lake Sammamish Flood Control Zone District, the city of Bellevue and the city of Redmond for the transfer of district responsibilities and assets, upon abolishment of the district, to Bellevue and Redmond, and to execute deeds to any storm water related real property interests that may be held in the name of King County within the boundaries of the district.

STATEMENT OF FACTS:
1. The West Lake Sammamish Flood Control Zone District ("the district") was formed in April 1963 through adoption of Resolution 25759 by the King County board of commissioners, acting under the terms of chapter 86.15 RCW, which authorizes the formation of flood control zone districts by the county legislative authorities. Upon formation of the district, the board of county commissioners became ex officio the board of supervisors of the district.
2. When the district was originally created, most of its area was within unincorporated King County and under the political jurisdiction of King County.
3. The board of supervisors in November 1964, through Resolution 28921, assessed a fee of three hundred dollars per developed acre within the district for developing properties that did not provide for storm water trunk lines, which are those storm water pipes that convey storm water from the perimeter of a platted property to the natural watercourse.
4. The development fees collected by the board were placed in a fund managed by the King County treasurer, and the funds were used to further the purposes of the district, including the construction and maintenance of a number of storm water control facilities. There currently remains a balance of approximately three hundred twenty-five thousand dollars in the district's fund.
5. Since the creation of the district, the cities of Bellevue and Redmond have annexed all of the area within the district. Bellevue and Redmond have storm water management regulations and programs that address storm water conveyance and have financing mechanisms to fund the programs.
6. The original purposes for which the district was established can now be satisfied by the storm water programs of the cities of Bellevue and Redmond, and thus the continued existence of the district is unnecessary and potentially duplicative of the services and facilities provided by the programs of the cities of Bellevue and Redmond.
7. The members of the King County council are ex officio members of the board of supervisors of the district.
8. The King County council recognizes that at this time the district should be abolished and all of the responsibilities of the district, the balance of its funds and its facilities and title to its properties should be transferred to the city jurisdiction, either the city of Bellevue or the city of Redmond, within which the facility or property is located.
9. A number of storm water related real property interests and facilities within the district's boundaries may be held in the name of King County. The county desires that these real property interests and facilities, when located within the jurisdiction of Bellevue, be transferred to Bellevue, and when located within the jurisdiction of Redmond, be transferred to Redmond.
10. The county has in its possession documentation relating to a number of storm water related facilities and real property interests held by the district, and storm water related real property interests and facilities that may be held in the name of the county within the boundaries of the district. Bellevue and Redmond desire to have this documentation, and King County is willing to transfer the documentation to Bellevue or Redmond.
11. Bellevue, Redmond, the district and the county believe that it is in the public interest that as part of the process of abolishing the district, any and all district assets and any storm water related real property interests and facilities held in the name of King County within the boundaries of the district be transferred to Bellevue and Redmond, and to enter into an interlocal agreement that will provide the terms for the transfer.
12. In accordance with chapter 39.34 RCW, the Interlocal Cooperation Act, the parties to the interlocal agreement are each authorized to enter into an agreement for cooperative action.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. The King County executive is hereby authorized to enter into an interlocal agreement, in substantially the same form as Attachment A to this ordinance, with the West Lake Sammamish Flood Control Zone District ("the district") and the cities of Bellevue and Redmond for transfer of district assets and funds, and any storm water related facilities and real property interests held in the name of King County within the boundaries of the district to the cities of Bellevue and Redmond.
SECTION 2. The King County executive is hereby authorized to execute deeds of conveyance in favor of the cities of Bellevue and Redmond for any and all storm water related real property interests that may be held in the name of King County and that are located within the boundaries of the district.
SECTION 3. Upon execution of the interlocal agreement referred to in section 1 of this ordinance by all of the named parties, all storm water related facilities that are held in the name of King County and that are located within the boundaries of the district shall be and are hereby transferred to the cities of Bellevue and Redmond.
