AN ORDINANCE authorizing the vacation of a portion of M. E. Ely Road, File V-2431.  Petitioners:  Allen J. Watts and Muriel J. Watts.

      STATEMENT OF THE FACTS
1.  A petition has been filed requesting vacation of that portion of M. E. Ely Road hereinafter described.
2.  The department of transportation notified the various utility companies serving the area and has been advised that all necessary easements have been acquired within the vacation area.
3.  The department of transportation records indicates that King County has not been maintaining M. E. Ely Road.  The records indicate that no public funds have been expended for its acquisition.  
4.  A portion of an existing house encroaches onto the M. E. Ely right-of-way.  This house is owned by Gary Kawasaki and Shirley Naganawa who support the vacation petition.  The proposed vacation area encompasses this encroachment.  In a separate private agreement the encroachment issue will be addressed between the petitioner and the home owners.
5.  The department of transportation considers the subject portion of the right-of-way useless as part of the county road system and believes the public would benefit by the return of this unused area to the public tax rolls.
6.  The right-of-way is classified as "C-Class" and, in accordance with K.C.C. 14.40.020, the compensation due King County is based on fifty percent of the assessed value of the subject right-of-way which was determined from records of the department of assessments.  King County is in receipt of $1,224.72 from Gary Kawasaki and Shirley Naganawa.
Due notice was given in the manner provided by law and a hearing was held by the office of the hearing examiner on the 16th day of April, 2003.
In consideration of the benefits to be derived from the subject vacation, the council has determined that it is in the best interest of the citizens of King County to grant said petition.
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  The council, on the ____ day of _________________, 2003, hereby vacates and abandons that portion of M. E. Ely Road as conveyed to King County by with the recording of Martinolich Addition to Dockton as recorded in Volume 22 of Plats, Page 74, records of King County, Washington described as follows:
That portion of Government Lot 2 in Section 30, Township 22 North, Range 3 East, W.M., described as follows:  Beginning at the northeast corner of said Government Lot 2 and running N 89 45'W along the northerly boundary line 873.06 feet to the westerly margin of the M. E. Ely County Road; thence S 15 17'W along said westerly margin, 20 feet to the true point of beginning; thence S 15 17' W, 103.2 feet; thence S 89 45'E, 10.35 feet; thence N 15 17'E, 103.2 feet; thence N 89 45'W, 10.35 feet to the true point of beginning.
