STATEMENT OF FACTS
1.  The King County council, on November 23, 1998, by Ordinance 13340  did adopt the annual budget and program, and did provide therein for a transportation program that included the replacement of Mount Si Bridge 2550A.
2.  The Replacement Design Memorandum dated April 2001 recommends certain design criteria and alignment alternatives for the Mount Si Bridge 2550A replacement.  The State Environmental Policy Act (Chapter 43.21C RCW) requires the county to evaluate the alignment alternatives before deciding on the final alignment of the bridge replacement.
3.  It is necessary to obtain property rights to enter private property to conduct topographical surveys; identify, locate and survey environmentally sensitive areas; survey potential wetland resource areas; conduct geotechnical soil borings and studies; and all other assessments and testing necessary for compliance with the State Environmental Policy Act and other applicable laws, regulations and requirements in order to evaluate the alignment alternatives for the bridge replacement.
4.  The King County council on November 19, 2001, by Ordinance 14265 did adopt the 2002 budget and program and did provide therein for a transportation program. The capital budget and program provides for the acquisition of land necessary for the replacement of the Mount Si Bridge 2550A, Right-of-Way No. 9-1998-018.
5.  In order to acquire the property and property rights required to accomplish the evaluation of the alternative alignments for the replacement of Mount Si Bridge 2550A, it is necessary for King County to condemn certain lands, property, property rights, and/or rights in property for road purposes as hereinafter more particularly set forth.
6.  The King County council finds that public health, safety, necessity and convenience demand that Mount Si Bridge 2550A, Right-of-Way No. 9-1998-018, be improved within King County in accordance with the capital budget and program, and that certain lands, properties, property rights, and/or rights in property be condemned, appropriated, taken, and damaged for purpose of evaluation of the alternative alignments for the replacement of Mount Si Bridge 2550A, Right-of-Way No. 9-1998-018, as provided in this ordinance.
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  The King County council deems the replacement of the Mount Si Bridge 2550A to be a public use of the county.  Further, the King County council deems it necessary and in the best interest of the citizens of King County that the lands, property, property rights and/or rights in property described in Attachment B to this ordinance be condemned, appropriated, taken, and/or damaged, subject to the making or paying of just compensation to the owners thereof in the manner provided by law.
      SECTION 2.  Condemnation proceedings are hereby authorized to acquire the lands, property, property rights and/or rights in property described in Attachment B to this ordinance for the purpose of the above-described Mount Si Bridge replacement project.
      SECTION 3.  The attorneys for King County are hereby authorized and directed to begin to prosecute the proceedings provided by law to condemn, take, damage and/or appropriate the lands, property, property rights and/or rights in property necessary to carry out the provisions of this ordinance.
