Title
A MOTION recognizing Service Employees International Union Local 519 as the exclusive bargaining representative for specified nonsupervisory employees within King County Civic Television in the legislative branch of county government.
Body
      WHEREAS, King County Civic Television (CTV) is an independent agency within the legislative branch of county government, and
      WHEREAS, public employees have the right to join labor organizations of their own choosing and to be represented by such organizations in matters concerning their employment relations with public employers under RCW 41.56.010, and
      WHEREAS, employees within CTV have expressed a desire to be represented and have engaged in an approved process resulting in the selection of Service Employees International Union (SEIU), Local 519, as their exclusive bargaining representative, and
      WHEREAS, a legal presumption exists that supervisory employees should be excluded from bargaining units containing their rank-and-file subordinates (WAC 391-35-340), and
      WHEREAS, the station manager for CTV exercises authority on behalf of the council over subordinate employees within CTV, and whose supervisory duties include, among other things, directing day-to-day operations of CTV, overseeing program development, preparing the annual budget, and assigning, training, supervising, motivating, and reviewing the performance of CTV staff;
      NOW, THEREFORE, BE IT MOVED by the Council of King County:
      A.  The council recognizes the newly created bargaining unit of nonsupervisory employees within King County Civic Television (CTV) in the legislative branch of county government.
      B.  The council recognizes Service Employees International Union (SEIU) Local 519 as the exclusive bargaining representative for the bargaining unit within CTV.
      C.  The council recognizes the following positions as being represented by SEIU, Local 519, in the newly formed bargaining unit of nonsupervisory employees:  CTV Operations Specialist I, CTV Operations Specialist II, CTV Operations Specialist III, and CTV Production Coordinator.  The council finds that the station manager position is
 
supervisory in nature and should not be included within the same bargaining unit as nonsupervisory employees.
