Title
A MOTION stating King County's elections under Public Law 106-393, the Secure Rural Schools and Self-Determination Act of 2000, as amended, for the federal fiscal year ending September 30, 2008.
Body
      WHEREAS, on October 3, 2008, Congress enacted Public Law ("P.L".) 110-343, which included reauthorization of and amendment to P.L.106-393, the Secure Rural Schools and Self-Determination Act of 2000, and
      WHEREAS, P.L. 106-393, as amended, allows transition payments to eligible counties in covered states, referred to as the full funding amount, which are calculated as a percentage of the full funding amount for 2006, and
      WHEREAS, Washington is a covered state and King County is an eligible county, and
      WHEREAS, P.L. 106-393, as amended, requires that eligible counties notify the Secretary of Agriculture of their election to receive the full funding amount or the twenty-five percent payment, which election shall be effective for all subsequent federal fiscal years through fiscal year 2011, and
      WHEREAS, if an eligible county elects to receive the full funding amount, not less than eighty percent and not more than eighty-five percent shall be expended in the same amount as the twenty-five percent payments are to be expended, which is for schools and roads, as described in Title I, and
      WHEREAS, annually the county shall elect to allocate the balance to projects in accordance with Title II, Special Projects on Federal Lands, and Title III, County Funds, with not more than seven percent of the total payment allocated to Title III;
      NOW, THEREFORE, BE IT MOVED by the Council of King County:
      A.  King County hereby elects to receive the full funding amount.
      B.  King County hereby elects to allocate eighty-five percent of the full funding amount to be expended for roads and schools as described in Title I, for federal fiscal year 2008.
      C.  King County hereby elects to allocate eight percent of the full funding amount to Title II.
 
      D.  King County hereby elects to allocate seven percent of the full funding amount to Title III.
