Title
AN ORDINANCE establishing November 2, 2010, as the date of a special election on the question of annexation to fire district 28 of the city of Enumclaw; and declaring an emergency.
Body
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. Findings:
A. Fire district 28, by Resolution No. 10-003, has determined that it is in the best interests of the district and the public to include the city of Enumclaw, in accordance with chapter 52.04 RCW.
B. The city of Enumclaw, by Ordinance No. 2445, showed its intent to join fire district 28 and found that the public interest would be served thereby.
C. The King County boundary review board received a request for review under chapter 36.93 RCW, and on March 13, 2010, the review board, in file 2310, deemed the proposed annexation approved.
E. Pursuant to chapters 29A.04 and 52.04 RCW, the metropolitan King County council deems an emergency exists for the purpose of calling a special election to be held on the question of this annexation on November 2, 2010.
SECTION 2. A special election shall be held on the 2nd day of November 2010 in accordance with chapter 35A.14 RCW within the territory of fire district 28 and the city of Enumclaw, for the purpose of submitting the question of annexation of the city of Enumclaw into fire district 28.
SECTION 3. The number of residents within the city of Enumclaw is estimated at 11,460 as nearly as may be determined from available records. The number of residents in the territory of fire district 28 is estimated at 8,293 as nearly as may be determined from available records.
SECTION 4. Pursuant to RCW 29A.04.321 and 52.04.071, it is hereby deemed that an emergency exists for purposes of calling a special election. The King County director of the elections division is hereby requested to assume jurisdiction to call and conduct a special election and submit to the registered voters within the city of Enumclaw and the territory of fire district 28 of the proposit...
