    1. AN ORDINANCE authorizing the vacation of a portion of 314th Way Southeast File V-2399 Petitioners:  Frank Berte and Karl and Vero Ward.

      STATEMENT OF FACTS:
  1. 1.  A petition has been filed requesting vacation of that portion of 314th Way Southeast hereinafter described.
  2. 2.  The department of transportation notified the various utilities companies serving the area and was advised that no easements were required within the vacation area.
3.  The department of transportation records indicates that King County has not maintained 314th Way Southeast.  The records indicate that no public funds have been expended for its acquisition.  
4.  The department of transportation considers the subject portion of the right-of-way useless as part of the County road system and believes the public would benefit by the return of this unused area to the public tax rolls
  1. 5.  The right-of-way is classified as "C-Class" and, in accordance with King County Code 14.40.020, the compensation due King County is based on fifty percent of the assessed value of the subject right-of-way which was determined from records of the department of assessments.  King County is in receipt of $7,218.00 from the petitioners.
6.  The right of way is adjacent to the Burlington Northern Santa Fe Railway Company corridor which has been identified in the King County Trails Plan as a potential future trail corridor and King County desires to retain any potential reversionary interest in the railway corridor which upon abandonment might adhere to the road right of way.
  1.       Due notice was given in the manner provided by law and a hearing was held by the office of the hearing examiner on the 28th day of November, 2000.
      In consideration of the benefits to be derived from the subject vacation, the council has determined that it is in the best interest of the citizens of King County to grant said petition.
  1.       BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
  2.       SECTION 1:  The council, on the ____ day of _________________, 2000, hereby vacates and abandons that portion of 314th Way Southeast described as follows:
      That portion of 314th Way Southeast, dedicated as Railroad Avenue abutting Lots 7 through 12, Block 3, Townsite of Cumberland, according to Volume 19 of Plats, Page 52, records of King County, Washington.
      SECTION 2:  King County reserves all claims of reversionary interest to the Burlington Northern Santa Fe Railway right of way which may adhere to those portions of the vacated and abandoned right of way of 314th Way Southeast adjacent to said railway right of way in the event such railway right of way is abandoned.
