Title

AN ORDINANCE authorizing the King County executive to execute an amendment to the interlocal agreement with the King County flood control zone district extending the duration of the interlocal agreement through December 31, 2021.

Body

STATEMENT OF FACTS:

1.  King County and the King County flood control zone district entered into the Interlocal Agreement Between King County and the King County Flood Control Zone District Regarding Flood Protection Services, effective January 1, 2016.

2.  Over the next four years, the interlocal agreement has been amended to extend the term of the interlocal agreement.

3.  Currently, the interlocal agreement shall terminate on December 31, 2020.

4.  The COVID response efforts have resulted in a delay in completing for a negotiation on a new or amended interlocal agreement.

5.  The county and the district desire to continue to operate under the terms of the interlocal agreement until new interlocal agreement terms can be finalized.  To that end, and to preserve the status quo, it is anticipated that at a meeting in October the district's board of supervisors  will adopt a resolution s approving the extension of the interlocal agreement to December 31, 2021, consistent with proposed fourth amendment, which is Attachment A to this ordinance.

6.  Extending the current interlocal agreement is necessary for the immediate preservation of the parties' ability to continue, unabated, to provide flood management and protection services, which will preserve the health and safety of the residents of King County and help protect them from the ravages of flooding.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  The council supports and authorizes the executive to execute a fourth amendment, substantially in the form of Attachment A to this ordinance, to the

current interlocal agreement entitled Interlocal Agreement Between King County and the King County Flood Control Zone District Regarding Flood Protection Services.
