AN ORDINANCE revising the corporate boundary of the city of North Bend to include 428th Avenue Southeast, and segments of Southeast 136th Street and 436th Avenue Southeast public rights-of-way within the city as provided for in RCW 35.21.790.

STATEMENT OF FACTS:

1.  RCW 35.21.790 provides the mechanism to allow cities within King County to adjust their boundaries to include entire rights-of-way of roads within the city.  RCW 35.21.790 provides that "[t]he governing bodies of a county and any city or town located therein may by agreement revise any part of the corporate boundary of the city or town which coincides with the centerline, edge, or any portion of a public street, road or highway right-of-way by substituting therefor a right-of-way line of the same public street, road or highway so as fully to include or fully to exclude that segment of the public street, road or highway from the corporate limits of the city or town."

2.  Revision of the corporate boundary of a city is effective upon approval by the city council and the county legislative authority as provided for in RCW 35.21.790.

3.  King County has jurisdiction over the eastern half of the road right-of-way for 428th Avenue Southeast in the area described in Attachment A to this ordinance. 

4.  King County also has jurisdiction over the western leg of Southeast 136th Street and southern leg of 436th Avenue South of the intersection at Southeast 136th Street and 436th Avenue Southeast in the area described in Attachment B to this ordinance.

5.  It is in the city and the county's best interest to amend the corporate boundaries of the city so that the public rights-of-way described in Attachments A and B to this ordinance are located in their entirety within the city so that the city may provide local services to its residents including the maintenance, operation and capital improvements of the public rights-of-way.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  Findings:

                     A.  The corporate boundaries of the city of North Bend coincide with the centerline of the public right-of-way for 428th Avenue Southeast in the area described in Attachment A to this ordinance and the west margin of Southeast 136th Street and the south margin of 436th Avenue Southeast in the area described in Attachment B to this ordinance.

                     B.  The city of North Bend city council approved city Ordinances No. 1696 and 1717 to revise the city's corporate boundaries to include portions of 428th Avenue Southeast, Southeast 136th Street and 436th Avenue Southeast public rights-of-way currently within unincorporated King County into the corporate limits of the city.

                     SECTION 2.  The revision of the corporate boundaries of the city of North Bend to include the portions of 428th Avenue Southeast, Southeast 136th Street and 436th Avenue Southeast public rights-of-way currently within unincorporated King County, legally described as set forth in Attachments A and B to this ordinance, is hereby approved.
